CONDOMINIUM ASSOCIATIONS

Notary for Massachusetts 6D Condominium Certificates

When a condo unit is sold or refinanced, the association issues a 6D certificate confirming the unit's common charges are paid. The certificate must be signed by a trustee or authorized manager and notarized so it can be recorded. We come to trustees and property managers wherever they are, so certificates don't hold anything up.

About 6D certificates

A 6D certificate, named for Section 6(d) of Massachusetts General Laws Chapter 183A, states whether a unit owner owes common expenses or other charges to the condominium association. Buyers' and lenders' attorneys need it, and it's recorded at the Registry of Deeds, so the signature must be notarized. Trustees are often volunteers with busy schedules, which is where a mobile notary helps.

Who we work with

  • Condominium trustees and board members
  • Property management companies
  • Self-managed associations
  • Attorneys requesting certificates from associations
  • Associations with trustees in different locations

The association prepares the certificate. We notarize the authorized signer's signature.

At home, the office or the management company.

  3. 3

    Signed and notarized

We verify ID and notarize the signature.

  4. 4

What happens at your appointment

The trustee or authorized signer shows valid photo ID and signs the certificate in front of us, and we complete the acknowledgment so the certificate can be recorded at the Registry of Deeds. We check that the signer's name and title on the certificate match the ID and the signature block. If several trustees need to sign, we can meet them together or one at a time at their homes or offices.

Mistakes we help you avoid

  • The wrong signer. Associations should confirm who is authorized to sign. When a manager signs, attorneys often look for a recorded delegation of authority.
  • Missing recording details. For trust-based associations, the statute asks the certificate to reference where the signers' authority is recorded. Have that information ready.
  • Signing before the notary arrives. An acknowledgment requires the signer to acknowledge the signature in front of us.
  • Last-minute scrambles. Under Massachusetts law, the association generally has ten business days to provide the certificate after a written request. A mobile notary helps you meet that window.

Why recording matters

Once a 6D certificate is recorded at the Registry of Deeds, it discharges the unit from the association's lien for sums unpaid at that time, beyond what the certificate lists. That's why buyers' and lenders' attorneys insist on a properly notarized certificate, and why the signature block needs to be right the first time.

Frequently asked questions

Do you prepare the 6D certificate?

No. The association or its manager prepares it. We notarize the authorized signer's signature. We're notaries and document specialists, not attorneys, so we can't give legal advice, draft documents or explain their legal effect.

Can you notarize for more than one trustee?

Yes, in one visit or at separate locations.

How fast can you come?

Often the same or next day in Greater Boston.

Do you work with management companies regularly?

Yes. Ask about recurring support.

Can a property manager sign the 6D?

Sometimes, if the board has delegated that authority. Many attorneys look for that delegation to be recorded. Ask your association's attorney.

Do you notarize other condo documents?

Yes, including trustee certificates, amendments and board resolutions.

Can you meet trustees at the property?

Yes, at the building, a trustee's home or the management office.
