How documents for Hong Kong work

Hong Kong has applied the Hague Apostille Convention since April 25, 1965, and it continued to do so after 1997. Its status is separate from mainland China, which joined the Convention in 2023, and Hong Kong has its own apostille authorities. For U.S. documents going to Hong Kong, a single apostille from the correct U.S. office is all that is needed: the Massachusetts Secretary of the Commonwealth for Massachusetts documents, the issuing state for records from other states, and the U.S. Department of State for federal documents such as FBI background checks. English is one of Hong Kong's official languages, so documents in English are generally accepted without translation.

Hong Kong, Macau and mainland China

These are three different destinations for document purposes. Hong Kong and Macau have accepted apostilles for many years, while mainland China joined the Convention on November 7, 2023. Translation needs differ as well: English is official in Hong Kong, while mainland Chinese offices usually ask for a Chinese translation. Always tell us the exact destination, and we prepare your documents for that office. See Apostille for China.

Banks and company secretaries publish their own checklists, and they change. We prepare each document to the exact list you receive.

Working with Hong Kong banks and company secretaries

Hong Kong banks apply detailed know-your-customer reviews, and corporate clients are usually asked for a full set of formation records, resolutions and signatory documents. Delays most often come from small inconsistencies: a resolution that names a signatory differently from the incumbency certificate, a good standing certificate that is several months old, or a document signed by an officer whose authority is not shown elsewhere in the package. Because we prepare the whole set together, we check that names, titles and dates match across every document before anything is notarized or filed. For companies, we can come to your office anywhere in Greater Boston to notarize several signers in one visit. See On-Site Corporate Notary.

Employment visas and relocating staff

Professionals relocating to Hong Kong, and the companies sponsoring them, are often asked for evidence of qualifications and background: degree certificates and transcripts, an FBI background check, employment and reference letters, and birth and marriage certificates for a spouse and children applying as dependants. Each document goes to a different office. Diplomas from Massachusetts schools are certified by the registrar and apostilled by the Secretary of the Commonwealth, FBI checks receive the federal apostille from the U.S. Department of State, and records from other states are apostilled by the state that issued them. For HR and global mobility teams, we coordinate the full set for each employee and keep the team informed at every step. See Employee Relocation and Diplomas and Transcripts.

Personal and family matters

Individuals and families also send documents to Hong Kong for property transactions, estate administration, marriage and family matters. A Hong Kong solicitor handling a property sale or an estate will often supply a power of attorney, statutory declaration or affidavit to be signed in the United States. Because a Massachusetts notary notarizes the signature rather than the content, these documents can be signed here in their final form, then apostilled for use in Hong Kong. We recommend sending us the document before your appointment so we can confirm that the signature block and notarial certificate will meet the Secretary of the Commonwealth's requirements. See Powers of Attorney and Trust and Estate Documents Abroad.

Timing

For Massachusetts documents, the apostille itself is typically issued within one to two business days once the document is ready. Records from other states depend on that state's processing time, and federal documents, such as FBI background checks, take longer because they go through the U.S. Department of State. Most Hong Kong requests are complete within a week when all documents are Massachusetts documents. When a bank appointment or filing deadline is fixed, tell us the date and we will plan backward from it. See Rush Apostille.

Common mistakes we help you avoid

  • Treating Hong Kong as mainland China. The rules, offices and translation needs differ. Name the exact destination.
  • A state apostille on an FBI check. FBI checks require the U.S. Department of State apostille.
  • Out-of-date company certificates. Banks and registries often want certificates issued within recent months.
  • Generic power of attorney wording. Hong Kong banks and solicitors frequently supply their own forms.
  • Photocopies of official records. Certified copies are required for an apostille.

Frequently asked questions

Does Hong Kong accept apostilles?

Yes. The Hague Apostille Convention has applied to Hong Kong since April 25, 1965, and it continues to apply.

Is Hong Kong the same as mainland China for apostilles?

No. Hong Kong has its own apostille status and authorities. Mainland China joined the Convention separately on November 7, 2023.

Do documents for Hong Kong need translation?

Usually not. English is an official language in Hong Kong, so English documents are generally accepted. If an office requests a Chinese translation, we can provide one.

Can you prepare corporate documents for a Hong Kong bank?

Yes, including certificates of good standing, resolutions and powers of attorney, prepared to the bank's checklist.

Who apostilles an FBI background check for a Hong Kong visa?

The U.S. Department of State, because it is a federal document. A state apostille is not accepted for it.

Can you notarize several company officers at once?

Yes. We come to your office anywhere in Greater Boston and notarize every signer in a single visit.

How long does it take?

Massachusetts apostilles are typically issued within one to two business days once the documents are ready. Federal and out-of-state documents take longer, and we confirm timing with your quote.

Can a Hong Kong solicitor's power of attorney be signed in Massachusetts?

Yes. We notarize your signature on the solicitor's document in its final form, and the Secretary of the Commonwealth apostilles it for use in Hong Kong. Send it to us before your appointment so we can confirm the signature block.

Do Hong Kong banks accept apostilled Delaware documents?

Delaware documents are apostilled by Delaware, and Hong Kong accepts apostilles from any U.S. state. We coordinate Delaware and Massachusetts documents in one order.

How recent must company certificates be?

Many Hong Kong banks and company secretaries ask for certificates issued within the last few months, so we order them close to your submission date.

Do you work with HR teams relocating employees?

Yes. We prepare diplomas, background checks and family records for each employee and keep the HR team informed throughout.

Do you ship to Hong Kong?

Yes, with tracking, to you, your company secretary, your solicitor or your bank.
