Retirement and pension forms that need a notary

Retirement paperwork often requires a notarized signature, and errors or delays can hold up a payment for weeks. The most common requirement is spousal consent: under federal rules for many employer retirement plans, a spouse's written consent to a distribution, loan or beneficiary designation that waives their survivor benefits must be witnessed by a plan representative or a notary public. Pension administrators, insurers and foreign pension authorities also ask for notarized signatures on distribution elections, beneficiary changes and proof-of-life certificates. We come to your home, workplace, hospital room or care facility, so retirees and their families do not have to travel.

Forms we notarize

  • 401(k), 403(b) and pension distribution and rollover forms
  • Spousal consent and waiver forms for plan distributions, loans and beneficiary designations
  • Beneficiary designation and change forms
  • Annuity and life insurance claim forms
  • Pension forms for public employees and union plans
  • Life certificates and proof-of-life forms for pensions paid by foreign governments
  • Medallion-style requests that a plan accepts with notarization (confirm with the plan first)

Notarization types for retirement forms

If the form says…Notarial actWhat to know
"Acknowledged before me"AcknowledgmentThe signer confirms signing voluntarily
"Sworn" or "subscribed and sworn"JuratThe signer signs in front of the notary and takes an oath or affirmation
"Notary witness" for spousal consentAs the plan's form specifiesUse the plan's own notary block, completed in full
A foreign pension life certificateAs the foreign authority specifiesSome require an apostille or consular step

Plan forms usually include their own notary section. We complete it as written, and use a Massachusetts certificate only when the form has none.

Good to know

Both spouses present

For spousal consent, the spouse giving consent must sign in the notary's presence. The participant does not always need to be there.

Do not sign in advance

Many forms must be signed in front of the notary. Wait until the appointment.

Bedside signings

We regularly notarize for retirees in hospitals and care facilities. See Hospital & Bedside Notary.

Pensions paid abroad

Foreign pension authorities often require a notarized life certificate and an apostille. See Which Countries Accept an Apostille?.

Common mistakes we help you avoid

  • Signing before the appointment. Many notary sections require signing in the notary's presence.
  • Blank notary fields. Plans reject forms with an incomplete date, county, seal or commission expiration.
  • Expired identification. Each signer needs current government photo identification.
  • The wrong spouse signature. Spousal consent must be signed by the spouse, not by the participant on their behalf.
  • Missing pages. Return every page the plan sent, even those without signatures.
