Documents for registering medical devices abroad

Foreign health authorities typically ask device manufacturers for proof that a device is legally marketed in the United States, evidence of quality certification, and documents appointing a local representative or registration holder. Each type of document is authenticated differently. FDA export certificates are federal documents, so they are apostilled or authenticated by the U.S. Department of State, not by Massachusetts, and they must never be notarized. Company-issued documents, such as declarations of conformity, letters of authorization and powers of attorney, are signed before a notary and apostilled by the state, or legalized for countries outside the Apostille Convention.

Electronic FDA certificates

Since January 2, 2024, FDA's device center issues export certificates as electronic PDFs that can be verified through a QR code. FDA states that apostilles and authentications of these certificates must be printed in color to be valid. Because notarizing a federal document invalidates it for authentication, we submit the color-printed certificate directly to the U.S. Department of State, using our DC Satellite Office to hand-carry submissions when timing matters. See Federal Document Apostille.

Common mistakes we help you avoid

  • Notarizing an FDA certificate. It cannot then be authenticated by the U.S. Department of State.
  • Black-and-white prints of electronic certificates. FDA requires color printing for authentication.
  • Apostilles for legalization countries. The UAE, Egypt, Kuwait, Qatar and Jordan require the legalization chain.
  • Inconsistent company details. Names, addresses and signatory titles should match across every document.
  • Expired certificates. Check validity dates before submission.
